SEEN Usage Agreement Guidelines

Grant to SEEN (Clarity Cosmetics)

By digitally complying to the following terms, you hereby grant to SEEN the worldwide right to use, publish, display, edit, modify and distribute any material, content, illustrations, photos, videos, comments or information (hereinafter, “Content”), including those bearing your name, voice, image, likeness, and/or any other identifiable representation of yourself (collectively, “Your Likeness”). This Content may appear in any form, style, color or medium whatsoever now known or later developed (including, without limitation, photographs, videotapes, films, sound recordings, software, drawings, prints, broadcast, in-store displays, internet, email, paid media,catalog and electronic media). 

Warranties and Disclaimers

By digitally complying, you warrant and represent that: (i) each party has the legal power to enter into this Agreement; (ii) you are the author of the Content and own all rights to use it or, alternatively, have the right to grant SEEN the rights described above; (iii) the Content does not infringe upon the copyrights, trademarks, rights to privacy, publicly or other intellectual property or other rights of any person or entity; (iv) publication of the Content via various media including Web posting, will not infringe on the rights of any third parties; (v) you have obtained permission from all persons, including parental consent for featured minors, whose name, voice, image, likeness and/or any other identifiable representation are included in the Content. You will indemnify and hold harmless SEEN from any claims to the contrary. 

Reservation Rights

Subject to the limited rights expressly granted in this Agreement, SEEN reserves all rights, title and interest in and to the Content, including all related intellectual property rights. No rights are granted to Your Likeness in this Agreement other than as expressly set forth in this Agreement.   

Acknowledge and Agreement 

By digitally complying, you hereby enter into this Agreement in perpetuity, acknowledge and agree to the above in consideration of the opportunity given to you by SEEN to be featured or have your Content, either tagged or untagged with @seenhairandskin, featured in SEEN promotional material across any SEEN digital channels. You acknowledge that you have fully read and understand this document and that you have had any questions regarding its effect or the meaning of its terms answered to my satisfaction. You certify that you are at least 18 years of age and provide parental consent for any minors featured within the Content.
